Addendum ADDENDUMS NO. 1 & 2

The City of Ashland, Kansas will receive sealed bids for the construction of Water System Improvements 2020 – Part 1 – Water Lines at the City Hall, 703 Main St., Ashland, KS 67831, until Thursday, January 28, 2021 at 1:00 P.M. (CT). Bids will be opened and read aloud via telephone and video conference immediately after the specified closing. Bids received after this time will not be accepted.

Bid Submittal Procedure:  Bids shall be delivered to the City Hall as indicated above. Due to ongoing health concerns, individuals will not be invited to attend the bid opening in person. As an alternative, interested persons may listen to a live teleconference of the bid opening by dialing 1-785-289-5712 and entering conference ID 602 126 72#. A link to the video feed of the bid opening will be sent to plan holder’s email addresses on the day prior to bid opening. Attendees are asked to keep their microphones on mute until after the bids are opened for questions or clarifications.

Major items of work: Water distribution system improvements including: 40 l.f. of 4”, 2,000 l.f. of 6”, and 1,000 l.f. of 8” AWWA C900 PVC water line; 2,200 l.f. directional boring; 28 gate valves; 5 fire hydrants; 38 service tie-ins/connections; paving; seeding; traffic control; project sign; and appurtenances.

Bidding Documents: Electronic copies of the bidding documents may be obtained through the Engineer’s website: www.ebhengineering.com/plan-room, by entering your information in the required fields. Addenda, if any and Plan Holders list will also be available through the EBH website Plan Room. Hard copies of the Bidding Documents are available at the Engineer’s office upon depositing $100.00 per set. No refunds will be made. The date that the Bidding Documents are downloaded by the contractor will be considered the prospective Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

Project Funding – This project is partially funded by the Kansas Public Water Supply Revolving Loan Fund through the Kansas Department of Health and Environment (KDHE), and partially funded by Community Development Block Grant # 20-PF-019 provided through the Kansas Department of Commerce. Attention of bidders is particularly called to the requirements as to conditions of employment to be observed and Federal prevailing wage rates to be paid under the contract (Davis Bacon Act), Section 3 of 1968 Housing Act, Segregated Facility, Section 109 of the 1984 Housing and Community Development Act and Executive Order 11246, and the Civil Rights Act of 1964.

Equal Employment OpportunityBidders on this work will be required to comply with the presidents Executive Order 11246 (Equal Employment Opportunity) as amended. Requirements for bidders and contractors under this order are explained in the specifications.

Anti-Discrimination – “Bidders on this work, including sub-contractors or vendors, will be required to comply with the Kansas Act Against Discrimination (K.S.A. 44-1001 et. seq.) and the Kansas Age Discrimination in Employment Act (K.S.A. 44-1111 et. seq.)”.

Responsibilities of Participants Regarding Transactions – “Bidders must fully comply with Subpart C of 2 CFR Part 180 and 2 CFR Part 1532, entitled Responsibilities of Participants Regarding Transactions. Contractors, subcontractors, or suppliers that appear on the Excluded Parties List System at www.sam.gov are not eligible for award of any contracts funded by the KDHE State Revolving Fund programs.,” or by Community Development Block Grant Funds.

Anti-Lobbying All contracts and subcontracts exceeding $100,000 at any tier under a SRF Loan Agreement shall comply with the Anti-Lobbying Act, Section 319 of Public Law 101-121, and file an Anti-Lobbying Certification form, and the Disclosure of Lobbying Activities form, if required, to the next tier above.

Davis Bacon Wage Determination – Conditions of employment to be observed and minimum rates to be paid under the contract (Davis Bacon Act), Section 3 of 1968 Housing & Urban Development Act. Bidders attention is directed to the Davis-Bacon Labor Standards Contractor’s Guide to Prevailing Wage Requirements for Federally-Assisted Construction Projects located at: https://www.hud.gov/sites/documents/4812-LRGUIDE.PDF.

American Iron and Steel – All of the iron and steel products used in the project must be produced in the United States. The term ‘‘iron and steel products’’ means the following products made primarily of iron or steel – lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. A Certification form must be submitted with the bid documents.

Labor Standards: The prevailing wage rates of the State of Kansas apply to this contract as do any requirements of the State of Kansas associated with the use of these State Prevailing wages. The prevailing wage rates of the Department of Labor apply to this project.

Bid security in the amount of 5 percent of the bid shall accompany each bid in accordance with Instructions to Bidders.

Owner reserves the right to waive irregularities and to reject any or all bids.

No bidder may withdraw his bid within 60-days after the actual date of the opening thereof.
